How can I compare the CreatedDate != LastModifiedDate on a Salesforce object. When I tried to use a filter with a static value and used CreatedDate as the value I go an error stating you can only do this Apex. Is there a way to do this?

Not through a query.
You would need to create a formula field to do this comparison for you, and then reference that field in your query. Typically a hidden formula checkbox is pretty common for this type of thing.
